In a case currently before US Federal Court in NYC lawyers for the US. Justice Department are arguing that non US visitors to the United States have no rights under US Law and may be seized without charge and held without trial indefinetly without benefit of a lawyer. If the judge buys this arguement it means that non-US citizens flying to a US port to board a cruise ship, or on a cruise ship that calls at a US port, or are in a stop-over at a US airport in transit to a third country could be seized and held in Gitmo-like circumstances'; to say nothing of the implications of tourists visiting the US or 'snowbirds' wintering in Florida or other southern states. The case is the Arar Case.

If something like this goes ahead and becomes a standard practise , the USA can pretty much kiss good bye to a mass market of (honest)tourist.They will have the fear of there background or the way there name is spelled will put them under suspicion.

The Justice Department's argument is pure nonsense and represents another example of the Bush administration's attempt to sidestep the US Constitution wherever they think they can get away with it, all under the pretext of national security. If the Federal Court rules in favour of this abominable proposition and the ruling gets upheld by the US Supreme Court, then the USA will be well on its way to becoming a police state.

The powers of ALL levels of government in the USA are limited by US Constitution and those limitations apply in their dealings with US citizens worldwide. They also apply in their dealings with both US citizens and foreign nationals within the boundaries of the USA and its territories. Many of the policies of the Bush administration with regard to security run counter to both the letter of, and the spirit of, the Constitution. Let us hope that the courts have more sense than Bush and his constitutionally challenged administration.

Agree 100%. The shrub caters to the fears of the lowest common denominator. Dont forget, John Ashcroft is guilty of this too.

In certain blogging circles that I belong to, the U.S. has taken non-U.S. Citizens and detained them in detention centers AND they have secret flights that take "said" persons to off site interrogators in foreign countries.

This issue has arisen and has been a discussion point in Canada after the Maher Arar case. He was on his way to a destination and was taken in a U.S. Airport during a stop over and was held in Syria for 2 years, being tortured and interrogated.

The U.S. will try to push the envelope and stir fear in travelers, Canadians are paying attention to these new rulings, but you know GWB will do his thing to the support of his christain puppeteers.

If this issue rises and becomes a practiced tool, the world will have to answer back. but as we know, GWB does not answer to anyone, not even the World War Crimes Tribunal to which he had been summoned this summer to answer for crimes against humanity.

The U.S. does no wrong and does not answer to anyone but God. Makes you wonder why the U.S. is scorned in so many places !! like Canada.

They are digging a pit they won't be able to get out of.

That would be a huge blow to cruise companies if they have to take on more passengers in foreign ports because passengers will fear traveling though the U.S. to get to a port of exit.

All hail the president and chief ....

What makes this all the more ridiculous is that all a would-be terrorist needs to do is enter the country through the unprotected Southern border. Tens of thousands cross illegally every year looking for work and health care and a few hundred terrorists could easily enter.

It will never happen. The very powerful tourist/hospitality industry lobby will prevent it. We have open borders now and once someone enters, they are completely safe from deportation. A would be terrorist will avoid traveling by air and simply walk across the open border. Bush and his big business buddies like it that way-scare honest tourists and ignore the real problems.
